TERMS & CONDITIONS
Seonaidh Jamieson t/a Seonaidh Jamieson Coaching, is based in Scotland. By making a purchase on our website, you agree that the law of Scotland will govern our relationship, and you agree to the following terms and conditions.
These Terms and Conditions are governed by and construed in accordance with the laws of Scotland. In the event of any dispute or claim, you agree to submit to the exclusive jurisdiction of the Scottish courts. T&Cs apply to all businesses of Seonaidh Jamieson.
If you breach these Terms and Conditions and we decide to take no action or neglect to do so, we will still be entitled to take action and enforce our rights and remedies for any other breach.
We will not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our reasonable control.
1. TERMS AND CONDITIONS
1.1 Agreement and Governing Law: These Terms and Conditions ("Agreement") constitute a legal agreement between Seonaidh Jamieson, operating as Seonaidh Jamieson Coaching, located in Scotland ("Service Provider"), and the purchaser ("Client"). The Agreement is governed by and construed in accordance with the laws of Scotland. Any dispute or claim arising from this Agreement shall be subject to the exclusive jurisdiction of the Scottish courts.
1.2 Applicability: These Terms and Conditions apply to all businesses operated by Seonaidh Jamieson.
1.3 Breach and Enforcement: If the Client breaches any of the terms and conditions stated in this Agreement, the Service Provider reserves the right to take appropriate action and enforce its rights and remedies for any breach, even if no immediate action is taken
1.4 The Service Provider shall not be held liable for any failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control.
1.5 To the extent permitted by law, our total aggregate liability arising in connection with our performance of this agreement shall be limited to the greater of (i) £250 or (ii) three times the price paid for the Programmes during the 12 months preceding the date on which the claim arose.
2. SERVICES
2.1 Services are delivered by Seonaidh Jamieson t/a Seonaidh Jamieson Coaching (SJC), Lighter Business Project (LBP) and the Pole Confidence Coach (PCC).
2.2 If you purchase services from SJC, LBP and/or PCC, these T&Cs apply and they constitute an agreement between you and Seonaidh Jamieson Coaching for the provision of those services.
2.3 Additional materials and pre-recorded training and coaching are not individually tailored to you.
2.4 Access to materials may be occasionally restricted or interrupted to allow for maintenance or updates. We will endeavour to restore access as soon as we reasonably can. Any such restrictions or interruptions shall not constitute a breach by us of these terms.
2.5 If you wish to cancel your booked services please email support@seonaidhjamieson.com as soon as possible, providing details of the services purchased and the reason for cancellation. Your cancellation will be granted subject to the cancellation policy for the for the service purchased as outlined in clause 4.
2.6 We are not certified specialists in Neurodivergence or additional needs, but we will accommodate as far as possible when your specific needs are communicated with us.
2.7 The efficacy of all training depends on the individual. Whether you achieve the results you want from your training will depend on many factors, including the effort you put in and your commitment. However, even if you follow your training precisely, you may still not achieve the results you seek. We, therefore, provide no warranties of any kind, express or implied, as to the effectiveness of the training that we provide or the results that you may achieve as a result of following them.
2.8 All services may include discussions about other areas of your life outside the initial scope. All discussions are confidential unless there are concerns for your safety or the safety of others. You will be supported using a range of techniques including but not limited to project management, NLP, timeline techniques, hypnotherapy, breathwork, yoga, corrective exercise, and nutrition coaching. We may recommend additional coaching or support if they would help you implement your plans, or if the exercises required are outside the scope of the services you have booked.
2.9 Services will be delivered online via Zoom at the agreed upon time unless specified otherwise at the time of booking and confirmed via email.
2.10 Your outcomes and objectives will be agreed upon before or at the beginning of your session.
2.11 Payment for services is due at the time of booking. Your booking is not confirmed until you have received confirmation that we have accepted it.
2.12 Seonaidh Jamieson Coaching services:
2.12.1 Seonaidh Jamieson Coaching provides coaching, hypnotherapy, and support to reach goals across a range of disciplines and situations. Your coaching will cover topics outside of the initial scope at times.
2.12.2 Coaching is a collaborative process and you may feel discomfort at some points. The more you communicate the more we can tailor our approach to best meet your needs.
2.13 Lighter Business Project services:
2.13.1 Lighter Business Project services will not provide accreditation or certificates of attendance, nor are they intended to do so. If you require accreditation please reach out and we will help you find a suitable provider.
2.13.2 Lighter Business Project services are not a substitute for legal advice or any industry-specific training you require. It focuses on your project and plan delivery. Where specific issues or questions arise, you may need to seek further professional support from accredited bodies or professionals.
2.13.3 Lighter Business Project services will not provide you with a business or project plan, instead you will be supported in creating your business or project plan.
2.14 Pole Confidence Coach services:
2.14.1 Masterclass bookings will be made via email. Attendees bookings will be handled by the studio booking software and invoiced by PCC. Minimum numbers apply and we are not liable for any losses as a result of low attendance.
2.14.2 Coaching to promote pole confidence may include topics outside of your pole dance training, including but not limited to stress reduction, nutrition, sleep hygiene, past experiences, and balanced exercise regiments.
2.1.9 To cancel your booking you must contact seonaidh@seonaidhjamieson.com no later than 2 business days before your package commences. Any cancellations within this period will be charged the full price. Where we are unable to provide services, you will be eligible to reschedule or receive a refund.2.1.10 Lighter Business Project Training is delivered as follows:Training is provided on Zoom and attended live at the pre-agreed time according to the package purchased.Lighter Business Project Training introduces you to project management principles and tailors their application to you and your business(es) as far as reasonably possible.
3. DATA HANDLING
3.1 Personal information you provide to us will be handled in accordance with our Privacy and Data Protection Policy, which you can view here.
4. CANCELLATION POLICIES
4.1 COACHING, HYPNOTHERAPY & TIMELINE TECHNIQUES: Coaching packages (including Single, Block of 3, Block of 6), Make Movement Easy Packages and Pole Confidence Coaching require a minimum of 24-hour notice for cancellations. Failure to provide the required notice will result in the Client forfeiting the right to a refund or reschedule. Refunds are only applicable to bookings made within the past 28 days. Refunds are not available after the commencement of a block of coaching sessions.
4.2 LIGHTER BUSINESS PROJECT TRAINING: The cancellation policy for Lighter Business Project VIP Week requires a minimum notice of 2 business days. Failure to comply with this policy will result in the Client being unable to reschedule or receive a refund.
4.3 PROJECT MANAGEMENT CONSULTING: For consulting services the terms of cancellation will be outlined in the specific agreement and terms of work provisioned.
4.4 All refunds are subject to the Client’s compliance with the specified cancellation policies. Eligibility for a refund is contingent upon adhering to the cancellation guidelines outlined in the terms and conditions of the respective service.
4.5 Clients are responsible for understanding and following the cancellation policies associated with their bookings. Failure to comply with the stated cancellation requirements may result in the forfeiture of the refund entitlement.
4.6 We encourage all clients to carefully review and adhere to the cancellation policies provided for each specific service to ensure a smooth and satisfactory experience.
4.7 By proceeding with a booking, the Client acknowledges their understanding of the refund policy and agrees to abide by the applicable cancellation guidelines.
5 ACCESS TO WORK CONTRACTS
Seonaidh Jamieson acknowledges that Access to Work funding may not be granted until after the service has been provided. In such cases, the following terms and conditions apply:
5.1 BOOKING AND PAPERWORK COMPLETION: Upon booking, the Client agrees to have the necessary paperwork for Access to Work completed on the same day as the service is being provided. The Service Provider will assist in the completion of the paperwork and ensure it is promptly sent off for processing.
5.2 CONFIRMATION REQUIREMENT: It is essential to receive confirmation from the Client that the Access to Work paperwork has been completed and submitted on the same day as the service is being provided. This confirmation serves as evidence of compliance with Access to Work requirements.
5.3 ADDITIONAL FEE: Due to the additional paperwork and administrative time involved, an extra fee of £35 per booking will be charged for services requiring Access to Work completion.
5.4 LIABILITY FOR OUTSTANDING AMOUNTS: If the Access to Work paperwork is not completed and submitted by the Client, they will be held liable for any outstanding amounts owed to Seonaidh Jamieson or any member of her team.
5.5 PAYMENT ISSUES: In the event of any payment issues arising from Access to Work, it is expected that all parties involved, including Seonaidh Jamieson and the Client, will promptly and diligently undertake the necessary communications and actions to address and resolve the matter urgently. Both Seonaidh Jamieson and the Client are responsible for taking proactive steps to ensure that any payment issues with Access to Work are given immediate attention and resolved in a timely manner.
5.6 By agreeing to these terms and conditions, the Client acknowledges their commitment to actively engage in addressing any payment issues related to Access to Work and to work cooperatively with Seonaidh Jamieson towards a swift resolution.
By accepting these Terms and Conditions, the Client agrees to be bound by the provisions outlined herein.
